Welcome to Wealth Within Walls (the “Website”), owned and operated by Tanya Armstrong, REALTOR® at D&B Real Estate (“we,” “us,” or “our”). Tanya is a licensed real estate agent in the State of Utah.

By accessing or using this Website, you agree to be bound by these Terms and Conditions (the “Terms”). If you do not agree with these Terms, please do not use the Website.

Please also review our Privacy Policy, which explains how we collect, use, and protect your personal information. By using this Website, you acknowledge that you have read and understood both these Terms and our Privacy Policy.

This Website is intended only for users who are at least 18 years of age. By accessing or using this Website, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into binding contracts. If you are under 18, you may not use this Website.

3. No Agency or Client Relationship Created by Website Use

Your use of this Website, including viewing properties or submitting contact forms, does not create a real estate agency, brokerage, or client relationship between you and Tanya Armstrong or D&B Real Estate.

Any agency or fiduciary relationship will only arise if and when you and Tanya enter into a written and signed representation agreement (such as a buyer-broker agreement or listing agreement), as required by Utah law and brokerage policy.

Until such an agreement is signed, we do not owe you any duties as a client, and the information on this Website is provided for general informational purposes only.

4. Intellectual Property Rights

All content published and made available on this Website is the property of Tanya Armstrong at D&B Real Estate and/or our content providers, unless otherwise noted. This includes, but is not limited to:

  • Text, articles, blog posts, and guides

  • Logos and branding

  • Photos, graphics, and videos

  • Downloadable resources and documents

  • Design, layout, and overall “look and feel” of the Website

We grant you a limited, non-exclusive, non-transferable license to view and use the Website for personal, non-commercial purposes only.

6. Prohibition on Data Mining, Scraping, and AI Training

Access to this Website does not grant any rights to use any content, including listings, property descriptions, images, or pricing data, for the purpose of:

  • Training Artificial Intelligence (AI) systems, Large Language Models (LLMs), or machine learning algorithms;

  • Data mining, scraping, crawling, or extracting data via automated systems (robots, spiders, etc.); or

  • Populating third-party databases or valuation models.

Any such unauthorized use is strictly prohibited. You agree that any violation of this section causes us irreparable harm and entitles us to immediate injunctive relief, as well as liquidated damages in the amount of $5,000 per violation or $500 per scraped record, whichever is greater.


 

7. Real Estate & IDX / MLS Information (No Warranties)

This Website may display property listings through IDX (Internet Data Exchange) and other third-party data sources, including one or more Multiple Listing Services (“MLS”).

While we strive to keep information accurate and up-to-date, you understand and agree that:

    All property details, including but not limited to price, square footage, lot size, boundaries, zoning, school assignments, availability, and features, are subject to change without notice.

  • Listings may not be our own.
    Many listings displayed may be provided by other brokers and agents via IDX/MLS reciprocity. Listing brokers/agents should be identified in the listing information where required.

    We make no representations or warranties, express or implied, about the completeness, accuracy, reliability, suitability, or availability of any listing data or other information on the Website.

  • Verify before you rely.
    You are responsible for independently verifying all information that is important to you, including by consulting the appropriate professionals (e.g., inspectors, surveyors, appraisers, attorneys, lenders, local government offices).

13. Not a Solicitation to Those Under Exclusive Contract

This Website and the information provided are not intended to solicit clients who are currently under an existing exclusive agency, brokerage, or representation agreement with another real estate professional.

If you are already represented by another brokerage, please consult directly with your current agent or broker.

14. Governing Law & Jurisdiction

These Terms are governed by and interpreted in accordance with the laws of the State of Utah, without regard to its conflict of law principles.

You agree that any disputes arising out of or relating to your use of the Website shall be brought in the state or federal courts located in the State of Utah, and you hereby consent to the personal jurisdiction of such courts.

15. Changes to These Terms

We may update or modify these Terms from time to time. When we do, we will update the “Last Updated” date at the top of this page.

Your continued use of the Website after any changes to the Terms constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you should stop using the Website.

16. Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Instead, such provision shall be modified to the extent necessary to make it enforceable, or if modification is not possible, it shall be deleted, and the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Website.
